Watch your mailbox: IRS warns of new scam targeting taxpayers via fake letter

The IRS is warning people of scammers targeting your mailbox with a new ploy to try and get your private information.

What makes this situation even more confusing for the average person is that the IRS does send real mail to taxpayers all the time, but officials warn this letter is different, and there are key signs to look out for when determining if a purported IRS mailing is legitimate.

The warning comes from the Security Summit, a coalition of IRS, state tax administrators and members of the tax industry, who say many have already fallen victim to this fake letter scam.

“This is just the latest in the long string of attempts by identity thieves posing as the IRS in hopes of tricking people into providing valuable personal information to steal identities and money, including tax refunds,” IRS Commissioner Danny Werfel wrote in a news release, detailing the scam.

The Security Summit warns this fake letter arrives in a cardboard envelope, with an IRS masthead and wording that the notice is in relation to the person’s unclaimed refund.

Scammers ask for the person’s driver’s license photo, bank information, routing numbers, social security number, and your cell phone number – details the real IRS says it would never ask for.

Officials warn the letter tells the recipients they need to provide “Filing Information” for their refund, including awkwardly worded requests like, “A Clear [Photo] of Your Driver’s License That Clearly Displays All Four (4) Angles, Taken in a Place with Good Lighting.”

Raphael Tulino, a spokesperson for the IRS, says consumers need to know the red flags.

“If you’re getting a letter from the IRS, take a look at it and you’re going to know it’s legit by the fact that it’s professional and it’s got all the information in it that you would assume to be an IRS letter, not a random one, and certainly not with all the bad punctuation and grammar that is in this particular scam,” Tulino said.

“Bottom line is, the IRS is not initiating contact, requesting personal, and sensitive information,” Tulino said. “That this is not how we do business.”

If someone receives one of these suspicious letters, officials stress to not call the phone number on the document. Taxpayers with questions should only call official IRS phone numbers that are on the IRS’ website.

A rare mosquito-borne virus, most often reported in the Upper Midwest, has been detected in Michigan

Two Michigan residents have contracted Jamestown Canyon virus, a mosquito-borne disease referred to as “rare but emerging” by the Cleveland Clinic, according to state health officials.

The Michigan Department of Health and Human Services said in a news release Friday that human cases of the virus have been confirmed in Macomb and Oakland counties, marking the state’s first cases of the year. Like other mosquito-borne illnesses, Jamestown Canyon virus is transmitted through the bite of a mosquito that has contracted the disease by feeding on an infected animal.

The majority of people who contract the virus don’t exhibit any symptoms, but some might become ill within two to 14 days after being bitten by an infected mosquito, according to Michigan DHHS. The most common symptoms are a high fever, confusion, muscle weakness and a severe headache. Serious complications, such as neurological diseases meningitis and encephalitis, can occur as well.

While found throughout much of the U.S., most cases are reported in the upper Midwest, according to the Centers for Disease Control and Prevention. The virus is classified as rare, though the CDC has noted an increase in reported cases in recent years, according to the Cleveland Clinic. The CDC received 267 reports of the virus between 2012 and 2021, most often in Wisconsin and Minnesota. In 2021 alone, 32 cases were reported.

There are currently no vaccines to prevent Jamestown Canyon virus, but you can reduce the risk of infection by taking general precautions against mosquito bites. Those include using Environmental Protection Agency-registered insect repellents, wearing lose-fitting, long-sleeved shirts and pants and repairing holes in screens to keep mosquitoes outdoors.

Other recommendations to prevent disease include staying inside at peak mosquito hours, like dusk and dawn, removing sources of standing water to reduce mosquito breeding habitats and sleeping inside or under protective netting while outdoors.

Pritzker defends Illinois bill that allows non-citizens to become police officers

Illinois Gov. J.B. Pritzker signed a bill last week that would allow for non-U.S. citizens to apply to become police officers, and on Monday he defended the legislation against critics.

During a press conference where he spoke about legislation protecting reproductive rights in the state, Pritzker emphasized that the bill would be limited to individuals who are legally allowed to work in the United States, and who are legally allowed to possess firearms.

“We have the ability for people who are legally here in this country, and permanent residents and DACA residents, to apply for jobs as police officers,” he said.

HB 3751 was passed by both chambers of the General Assembly earlier this year. The bill’s language says that “individuals who are not citizens, but are legally authorized to work in the United States under federal law” will be allowed to apply for jobs with police departments beginning on Jan. 1, 2024.

The bill is also generating backlash. Reps. Mary Miller and Lauren Boebert were among Republicans to condemn the bill, arguing that the legislation would allow individuals who entered the U.S. illegally to apply for positions.

Former Chicago mayoral candidate Willie Wilson also opposed the bill, arguing that it “defies common sense that non-citizens should be arresting and detaining legal citizens.”

Pritzker fired back at those criticisms, saying that it is a misrepresentation of the legislation’s language.

“I am tired of the right wing twisting things,” he said. “They put it on Facebook, they tell lies. There are people out there that think we’re just allowing anybody to become a police officer. That’s just not accurate.”

The governor also cited other states, including California, that have similar legislation on the books, and pointed out that thousands of legal permanent residents and DACA recipients are already serving in the United States military.

Representatives of both the Illinois Municipal League and the Chicago FOP Lodge #7 filed witness slips in support of the legislation, while the Illinois Association of Chiefs of Police opposed the measure.

Mega Millions jackpot hits $1.05 billion. Here's the possible tax bill for the winner

  • The Mega Millions jackpot has soared above $1 billion for the fifth time in history.
  • However, the winner will pay a significant chunk to Uncle Sam before seeing a penny of the windfall.

The Mega Millions jackpot has soared to more than $1 billion for the fifth time in the game’s history.

Currently, the 30-year annuitized payout is worth $1.05 billion, Mega Millions’ fourth-largest prize to date. Winners may also choose the popular lump-sum option for a $527.9 million payout.

However, both options are pretax estimates and the winner will pay a sizable chunk to the taxman before seeing a dollar of the proceeds.

Tuesday’s drawing is at 11:00pm ET.

Whether you choose the lump sum or annuitized 30-year payout, it’s important to seek expert guidance, said Tommy Lucas, a certified financial planner and enrolled agent at Moisand Fitzgerald Tamayo in Orlando, Florida.

“Call your estate planning attorney before you do anything,” he said.

Lucas recommends the winner hire a team of experts, including a financial advisor, tax professional, estate planning attorney, bank specialists and more, to navigate a range of financial decisions.

The chance of hitting the Mega Millions jackpot is roughly 1 in 302 million.

Withholding shrinks the prize by nearly $127 million

Before seeing a penny of the billion-dollar jackpot, the Mega Millions winner will pay a sizable chunk in taxes. There’s a mandatory 24% federal withholding for winnings above $5,000 that goes straight to the IRS.

If you choose the $527.9 million lump sum, the 24% federal withholding shrinks the prize by nearly $127 million.

However, that’s not the total tax bill, because the top tax bracket is currently 37%, according to Lucas, who encourages the winner to set aside 40% “just to be conservative.”

How federal tax brackets work

The Mega Millions jackpot easily pushes the winner into the top federal income tax bracket, which is currently 37%. But they won’t pay 37% on the entire windfall because “it’s going to flow through the brackets,” Lucas said.

For 2023, the 37% rate applies to taxable income of $578,126 or more for single filers and $693,751 or higher for couples filing together. You calculate taxable income by subtracting the greater of the standard or itemized deductions from your adjusted gross income.

Single lottery winners will pay $174,238.25, plus 37% of the amount over $578,125. But for couples filing jointly, the total owed is $186,601.50, plus 37% of the amount above $693,750.

The 24% federal withholding may cover a large amount of taxes, but the final bill will likely represent millions more, depending on several factors.

You may also be on the hook for state taxes, depending on where you live and where you bought the ticket. Some states don't tax lottery winnings or don't have income taxes, but others may levy above 10% in the top bracket.

Tuesday's MegaMillions drawing comes less than two weeks after a single ticket sold in California won Powerball's $1.08 billion jackpot. That game's top prize is back down to $74 million, with roughly 1 in 292 million odds of winning the jackpot.

Evanston police investigating after Pride flags vandalized with anti-LGBTQ rhetoric

Evanston police have launched an investigation after multiple Pride flags were found with anti-LGBTQ messages written on them, according to authorities.

The Evanston Police Department stated in a news release that on Thursday, officers were called to three separate locations regarding small Pride flags with the words “pride death” written on them. One of the flags had been burned, according to authorities.

Police said that the three incidents are believed to have occurred early Thursday morning in the 1700 block of Central Street, 2100 block of Central Street and 600 block of Dempster Street. Evanston police said that while what occurred is concerning and a priority for the department, the investigation has yet to reveal any specific threats to members of the LGBTQ community.

Man with Chicago ties wanted for setting girlfriend on fire in Kenosha County: authorities

Law enforcement in Kenosha County, Wisconsin, are searching for an individual with Chicago ties who is suspected to have set his girlfriend on fire, authorities said Sunday.

Myron Faith Bowie is believed to be driving a black Cadillac SRX with Illinois license plate DQ46996 and has ties to Logan Square and Wicker Park in Chicago, the Kenosha County Sheriff’s Department said in a news release.

At around 4:47 a.m. on Sunday morning, sheriff’s deputies responded to a house in the 24500 block of 86th Place in Salem Lakes, where a woman had called police, said her boyfriend had set her on fire and that she needed help. The victim suffered severe burns and was rushed to an area hospital in critical condition, according to authorities.

The Kenosha County Sheriff’s Department said the vehicle pictured above is similar to the one Myron Bowie could be driving.

According to police, Bowie and his girlfriend had an argument, during which he stated that he would kill her, her children and her entire family before setting her on fire and driving away.

Bowie, who is about 6 feet tall and weighs around 200 pounds, is wanted on a felony warrant and should be considered armed and dangerous, police said. World's longest elevated pedestrian loop opens for visitors, and it's located in the Midwest

A rather unique and breathtaking experience awaits nature enthusiasts and animal lovers in Minnesota.

The Minnesota Zoo, located in Apple Valley approximately 20 miles south of Minneapolis, on Friday officially opened its 1.25-mile Treetop Trail, which happens to be the world’s longest elevated pedestrian loop.

Situated up to 32 feet above ground, the attraction allows visitors to travel into trees and gain new perspectives on certain zoo animals, including tigers, moose, bison, camels and more, according to a news release. The trail, which is open year-round so guests can experience Minnesota’s four seasons, provides access to hardwood forests, ponds, marshes and diverse wildlife.

Touted as an “elevated experience,” according to the zoo’s website, the attraction “is a continuous, immersive greenspace bringing guests up to 32 feet into the canopy, offering a breath-taking view of the Zoo and animals below.”

“..In addition to creating a sense of awe and wonder, it connects guests with nature and inspires action to save wildlife in Minnesota and around the world,” its website read, in part.

While open to all zoo visitors, the trail might be especially eye-catching for birdwatchers. A total of 22 bump-out overlooks have been constructed across the path, offering especially stunning views.

Cactuses can withstand the heat right? In parts of Arizona, not so much

It’s so hot in Arizona’s capital that not even the cactuses are surviving.

Chief Science Officer Kimberlie McCue with the Desert Botanical Garden in Phoenix says this record-breaking stretch of heat is breaking cactuses all over the state.

People think, “Oh these are desert plants so they should be just fine,” McCue says. “But cactus are living things.”

Like all plants, saguaro cactuses use photosynthesis but they perform their essential functions at night when it’s supposed to be cooler.

Phoenix has had a record streak of 110-degree or more days and 90-degree or more nights. On Thursday morning, the temperature in Phoenix finally dipped below 90 degrees for the first time since July 9th.

The lack of a nighttime cooldown makes it difficult for the cactuses to recover. Instead, they’re “roasting.”

“They literally can’t function,” McCue says. “The way I describe it is they start to suffocate.”

At what temperature do cactuses die?

Plant physiologists at the Desert Botanical Garden are studying how much heat cactuses can take. Until recently, the assumption was that cactuses were perfectly adapted to withstand desert conditions.

“At a certain temperature or certain length of time, they just can’t do it anymore,” McCue says.

Sun scorch is a warning sign that the plant is starting to shut down. You’ll notice yellowing on the epidermis. If it’s noticed early and shading is applied, it may be reversed.

The garden can try to throw shade cloths over them but they can be 20-30 feet tall. Once they’re in bad shape, there isn’t much that can be done.

Severe sunburn will cause death of the outer epidermis, which will brown and may crack, resulting in a bark-like scarring, as outlined by the University of Arizona. The wounding caused by the sunburn can be an entry point for bacteria.

Do cactuses die in the cold?

While some cactuses will survive in cold areas with temperatures as low as -20F, others cannot tolerate anything below freezing.

If a cactus plant is exposed to temperatures that are too cold for its species, it can suffer damage. The most common type of damage is called “frost scald.” This occurs when the water inside the plant’s cells freezes, expands, and bursts the cell walls.

What are other signs that a cactus is dying?

Firmness is a good sign. If it’s soft or squishy that is an indicator that it’s in bad shape and likely won’t be able to hold itself up much longer.

If it has started to tilt, that probably means it’s on its way to falling over.

“If that plant is really starting to shut down, it doesn’t matter how much water you pour on them,” McCue says. “They won’t be able to take it up and do anything with it.”

Mass shooting at Indiana party leaves 1 dead, numerous victims hurt

A “mass shooting” at a large party in Indiana early Sunday morning left one person dead, police said. A hospital said 19 people were being treated for injuries at its facility.

Muncie police responded to multiple reports of gunfire on the city’s east side just after 1 a.m., The Star Press reported. Police said in a news release that there was no active threat to the community and that “multiple” victims were injured, including some critically.

“Due to the number of victims and nature of the incident, multiple agencies were contacted to assist,” Muncie Deputy Police Chief Melissa Criswell said in a statement sent to The Star Press.

Many police officers from the nearby town of Eaton were among those who provided assistance, according to a post on the department’s Facebook page. Eaton Police Chief Jay Turner called the incident a “mass shooting.”

Police did not say how many people were injured, but officials at Indiana University Health Ball Memorial Hospital in Muncie told The Associated Press that 19 victims were treated in their emergency department for injuries related to the shooting, and 13 remained at the hospital in stabilized condition Sunday morning. Criswell said some victims sustained critical injuries and were transferred by medical helicopter to other facilities.

Delaware County Coroner Gavin Greene identified the man who died as 30-year-old Joseph E. Bonner III, The Star Press reported.

Off-duty Chicago firefighter dies in Lake Michigan Sunday, officials say

An off-duty Chicago firefighter has died after they were pulled underwater while swimming on Sunday morning.

According to officials, the 43-year-old had just finished a shift and went for a swim at 31st Street Beach at approximately 7:30 a.m. when they disappeared beneath the water.

The firefighter was pulled from Lake Michigan, and was transported to an area hospital in critical condition.

Authorities say the man later died from his injuries. A procession took place Sunday afternoon, with firefighters, police officers and paramedics paying tribute to the victim as his body was transported to the Cook County Medical Examiner’s Office.

The firefighter’s identity has not yet been released, and an autopsy is pending.

No further information was immediately available.

2 boats wash ashore at Ohio Street Beach during overnight storms

Two large boats from the “playpen” area of Lake Michigan washed ashore during intense storms that were fueled by heavy rains and powerful wind gusts.

NBC 5’s Charlie Wojciechowski shared photos of the two boats, which remained stuck in the sand at Ohio Street Beach Saturday afternoon. At least one boat apparently tried to tie off to a buoy for safety, but the force of the waves brought both to shore.

Despite the boats’ presence, the beach was open as normal.

More Trader Joe's recalls? This soup may contain bugs and falafel may have rocks, grocer says

Trader Joe’s is recalling a broccoli cheddar soup that may contain insects and cooked falafel that may contain rocks, about one week after the grocery chain recalled two cookie products over similar concerns.

The soup recall impacts Trader Joe’s Unexpected Broccoli Cheddar Soup with “Use By” dates ranging from July 18 to Sept. 15, according to a Thursday announcement from the company. On Friday, the grocer announced that Trader Joe’s Fully Cooked Falafel sold in 35 states and Washington, D.C., was also under recall.

On July 21, Trader Joe’s announced that it was recalling Trader Joe’s Almond Windmill Cookies and Trader Joe’s Dark Chocolate Chunk and Almond Cookies with “sell by” dates ranging from Oct. 17 to Oct. 21. Like the falafel, the cookies may also contain rocks, the company said.

When asked for further information about how the insects and rocks may have gotten into these products, a Trader Joe’s spokesperson said that “there was an issue in the manufacturing processes in the facilities.” Suppliers alerted Trader Joe’s of the possible foreign material for each recall, the company said.

“We pulled the product from our shelves as soon as we were made aware of the issue. Once we understood the issue we notified our customers,” the spokesperson said in a statement sent to The Associated Press Saturday.

All of the recalled cookies, soup and falafel have been removed from sale or destroyed, Trader Joe’s said in its announcements. But the Monrovia, California-based company is still urging consumers to check their kitchens for the products.

Trader Joe’s says customers who have the recalled products should throw them away or return them to any store for a full refund. Lot codes and further details about the products under recall, as well as customer service contact information, can be found on the company’s website.

Trader Joe’s did not specify how many products were impacted with each recall or identify suppliers. But one Food and Drug Administration notice cited by NBC News says that the Unexpected Broccoli Cheddar Soup recall impacts around 10,889 cases sold in seven states. Winter Gardens Quality Foods, Inc. is identified as the recalling firm, per the notice.

No formal releases about the three recalls were published on the FDA’s Recalls, Market Withdrawals, & Safety Alerts page as of Saturday. The Associated Press reached out to the FDA and Winter Gardens Quality Foods for information on Saturday.

“We have a close relationship with our vendors and they alerted us of these issues. We don’t hesitate or wait for regulatory agencies to tell us what to do,” the Trader Joe’s spokesperson said. “We will never leave to chance the safety of the products we offer.”

Large fire engulfs suburban apartment complex during overnight storms

Authorities in suburban Oak Brook Terrace said Saturday an investigation was underway into a massive fire at an apartment complex that occurred late Friday night as storms rolled through.

Flames broke out at around 11:45 p.m. at the Arden of Oakbrook complex along Royce Boulevard north of Butterfield Road, said Richard Sanborn, fire chief with the York Center Fire District. Firefighters arrived at the scene and didn’t see any flames initially, but after investigating, discovered a heavy amount of fire inside the attic.

Crews spent several hours battling the flames and were able to extinguish the fire at around 4:30 a.m., Sanborn said. At least three firefighters sustained heat-related injuries and were transported to area hospitals, but had been released as of Saturday afternoon.

One resident told NBC Chicago that she was awoken by a neighbor and suddenly started knocking on other doors to alert others to ensure they would get out safely.

“I banged on the whole fourth floor,” Lydia Memeti said. “Everybody’s up and we stayed up until 2:30, and it’s getting worse and worse. Then I finally had to call my daughter to get me.”

In the midst of the chaos, Memeti said she managed to grab her keys – but wasn’t able to go back to get her other belongings.

“I don’t know what to say, but I have nothing,” she told NBC Chicago, visibly emotional. “I just got my two hands. I have no driver’s license, no passport, nothing. Everything was burnt.”

Another resident had just returned from a night out with friends when he hard alarms going off and saw commotion.

“It’s unreal,” Kendall Griffin said. “I’ve been here for over three years… beautiful place, I know many of the people that live here. it’s just devastating to see the damage. It didn’t look like it’s going to be that bad, and to see what it looks like this morning is unreal.”

The cause of the fire remained under investigation Saturday afternoon.

Here's when the school year will start for Chicago Public Schools students

Summer break will come to an end in a matter of weeks for some of the youngest Chicagoans.

While there’s still plenty of time left for back-to-school shopping and to soak up more of the summer sunshine, class will be back in session in the blink of an eye.

The district’s more than 300,000 students will return to school buildings on Monday, Aug. 21, according to the 2023-2024 academic calendar. Teachers and other personnel represented by the Chicago Teachers Union will head back a week earlier – on Monday, Aug. 14. Other school-based employees will return some time after the 14th, but prior to the 21st, as stated on the calendar.

In preparation of the new academic year, CPS is hosting a series of free back-to-school bashes, where families and students will have the chance to reconnect. A number of bashes are planned across the city through Aug. 18. Find the full list here.

With Trump facing new charges, here's what to know about the documents case and what's next

Former President Donald Trump has been indicted on three additional charges in a case that accuses him of illegally possessing classified documents at his Mar-a-Lago estate, allegations that add fresh detail to the criminal case initially issued last month.

Here’s a look at the charges, the special counsel’s investigation and how Trump’s case differs from those of other politicians known to be in possession of classified documents:

WHAT ARE THE NEW CHARGES?

There are three new charges against Trump, as well as a new defendant in the case.

Prosecutors accuse the former president of trying to “alter, destroy, mutilate, or conceal evidence,” and of inducing another person to do so. They say Trump asked a staffer — Mar-a-Lago property manager Carlos De Oliveira — to delete camera footage at his Florida estate in an effort to obstruct the federal investigation into his possession of classified documents.

Prosecutors allege that De Oliveira schemed with Trump and his valet, Walt Nauta, to conceal the footage from investigators.

A third count also accuses Trump of willfully retaining national defense information related to a presentation about military activity in another country.

Investigators say Trump showed a classified document during July 2021 meeting at his Bedminster, New Jersey, resort to the writer and publisher of the memoir of his former chief of staff Mark Meadows. Details about that document and the meeting were included in the original indictment, but none of the charges had related to it until now.

Trump had returned that document to the government on Jan. 17, 2022 — nearly a year after he left office, according to the indictment.

Trump was indicted last month on 37 counts related to the mishandling of classified documents. The charges include counts of retaining classified information, obstructing justice and making false statements, among other crimes.

Trump is accused of keeping documents related to “nuclear weaponry in the United States” and the “nuclear capabilities of a foreign country,” along with documents from White House intelligence briefings, including some that detail the military capabilities of the U.S. and other countries, according to the indictment. Prosecutors alleged Trump showed off the documents to people who did not have security clearances to review them and later tried to conceal documents from his own lawyers as they sought to comply with federal demands to find and return documents.

The top charges carry a penalty of up to 20 years in prison.

After leaving office in 2021, the former president showed someone working for his political action committee a map that detailed a military operation in a foreign country, prosecutors allege in the document. On another occasion that year, Trump showed a writer, a publisher and two of his staffers — none of whom had security clearances — a military plan of attack.

HOW IS TRUMP REACTING?

A Trump campaign statement dismissed the new charges as “nothing more than a continued desperate and flailing attempt” by the Biden administration “to harass President Trump and those around him” and to influence the 2024 presidential race.

In an interview Thursday night with Breitbart News, Trump called the superseding indictment “harassment,” repeating his insistence that his activities were “protected by the Presidential Records Act.”

On Friday, Trump and a dozen other Republicans seeking the 2024 presidential nomination were expected at an Iowa GOP event.

WHAT HAPPENS NEXT?

De Oliveira is due in court in Florida on Monday.

Both Trump and Nauta have pleaded not guilty to the original 38-count indictment.

Their trial is currently scheduled for May 20, 2024 — deep into the presidential nominating calendar, and probably well after the Republican nominee is known — and it was unclear if the addition of a new defendant could result in a postponement.

Prosecutors, who had wanted the case to go to trial in December, wrote in a separate court filing Thursday that the new charges “should not disturb” the May trial date, “and the Special Counsel’s Office is taking steps related to discovery and security clearances to ensure that it does not do so.”

Trump’s lawyers have claimed that he can’t get a fair trial before the 2024 election.

HOW DID THIS CASE COME ABOUT?

Officials with the National Archives and Records Administration contacted representatives for Trump in spring 2021 when they realized that important material from his time in office was missing.

According to the Presidential Records Act, White House documents are considered property of the U.S. government and must be preserved.

A Trump representative told the National Archives in December 2021 that presidential records had been found at Mar-a-Lago. In January 2022, the National Archives retrieved 15 boxes of documents from Trump’s Florida home, later telling Justice Department officials that they contained “a lot” of classified material.

That May, the FBI and Justice Department issued a subpoena for remaining classified documents in Trump’s possession. Investigators who went to visit the property weeks later to collect the records were given roughly three dozen documents and a sworn statement from Trump’s lawyers attesting that the requested information had been returned.

But that assertion turned out to be false. With a search warrant, federal officials returned to Mar-a-Lago in August 2022 and seized more than 33 boxes and containers totaling 11,000 documents from a storage room and an office, including 100 classified documents.

In all, roughly 300 documents with classification markings — including some at the top secret level — have been recovered from Trump since he left office in January 2021.

HOW DID A SPECIAL COUNSEL GET INVOLVED?

Last year, U.S. Attorney General Merrick Garland picked Jack Smith, a veteran war crimes prosecutor with a background in public corruption probes, to lead investigations into the presence of classified documents at Trump’s Florida estate, as well as key aspects of a separate probe involving the Jan. 6, 2021, insurrection and efforts to undo the 2020 election.

Smith’s appointment was a recognition by Garland of the politics involved in an investigation into a former president and current White House candidate. Garland himself was selected by Democratic President Joe Biden, whom Trump is seeking to challenge for the White House in 2024.

Special counsels are appointed in cases in which the Justice Department perceives itself as having a conflict or where it’s deemed to be in the public interest to have someone outside the government come in and take responsibility for a matter.

According to the Code of Federal Regulations, a special counsel must have “a reputation for integrity and impartial decision making,” as well as “an informed understanding of the criminal law and Department of Justice policies.”

DIDN’T BIDEN AND FORMER VICE PRESIDENT MIKE PENCE HAVE CLASSIFIED DOCUMENTS, TOO?

Yes, but the circumstances of their cases are vastly different from those involving Trump.

After classified documents were found at Biden’s think tank and Pence’s Indiana home, their lawyers notified authorities and quickly arranged for them to be handed over. They also authorized other searches by federal authorities to search for additional documents.

There is no indication either was aware of the existence of the records before they were found, and no evidence has so far emerged that Biden or Pence sought to conceal the discoveries. That’s important because the Justice Department historically looks for willfulness in deciding whether to bring criminal charges.

A special counsel was appointed earlier this year to probe how classified materials ended up at Biden’s Delaware home and former office. But even if the Justice Department were to find Biden’s case prosecutable on the evidence, its Office of Legal Counsel has concluded that a president is immune from prosecution during his time in office.

As for Pence, the Justice Department informed his legal team this month that it would not be pursuing criminal charges against him over his handling of the documents.

DOES A FEDERAL INDICTMENT PREVENT TRUMP FROM RUNNING FOR PRESIDENT?

No. Neither the indictment itself nor a conviction would prevent Trump from running for or winning the presidency in 2024.

And, as his indictment earlier this year in a New York hush-money case showed, criminal charges have historically been a boon to his fundraising. The campaign announced that it had raised over $4 million in the 24 hours after that indictment became public, smashing its previous record after the FBI search of Trump’s Mar-a-Lago club.

Several dogs die from heat stroke when air conditioning fails in truck, NW Indiana authorities say

Several dogs died from heat stroke and multiple others were rushed to veterinary hospitals on Thursday after an air conditioning unit malfunctioned while they were being taken to a training facility in Northwest Indiana, according to authorities.

The situation unfolded when the driver of a box truck was bringing 19 shepherds from O’Hare International Airport to a K-9 training facility located in Michigan City, Indiana, according to the Humane Society of Hobart. Lake Station police, which were called to investigate the incident, said the temperature began rising after an AC unit in the cargo area stopped working when the vehicle became caught in traffic for two hours. With the cargo area separated from the driver, he didn’t immediately realize what was happening until some of the dogs started barking, police said.

The driver subsequently stopped at the Road Ranger gas station on Ripley Street in Lake Station, just south of Interstate 94. He entered the cargo area, police said, saw that canines were in distresses and began removing those that were crated. As passersby stopped to help, multiple calls were made to 911, resulting in a response from police, firefighters and EMS personnel.

The Humane Society of Hobart, the contracted provider for animal care and control services in Lake Station, issued a statement of its own, criticizing Lake Station police for not following protocol and allowing the truck driver to leave with some of the animals without securing the vehicle – in violation of municipal code. Jenny Webber, the humane society’s executive director, explained in the news release that she responded to the scene, where she met with Sgt. McKenzie of the Lake Station Police Department and began to explain protocol. The sergeant said what occurred was simply a mistake and that the owner of the dogs was going to handle the situation, at which point Webber asked if the owner had valid vaccination records, permitted health certifications to establish safe temperatures for transport and a certified veterinary license to transport across state lines, according to the humane society.

“I stated that it appeared he was not in compliance with several of our codes and that we should seize all pets, transport medical patients to emergency care, do an investigation and return the animals once compliance was proved and fines and fees paid,” Webber wrote. “This made the owner very mad.”

The owner was derogatory and belligerent and then said he didn’t want anyone from the humane society to touch his dogs, according to the executive director. Webber explained that McKenzie complied with the owner’s request, while multiple vehicles with air conditioning stood by to transport additional dogs. As a result of the delay, she stated, more lives were lost.

Seven dogs were taken by ambulances instead of the vehicles waiting to respond, according to Webber. While she said that several of the animals had to be euthanized due to heat stroke, an exact number of how many dogs died has yet to be provided.

Webber said she then informed the police sergeant that the remaining four dogs on scene were in need of medical attention, but he permitted the owner to continue transporting those dogs and multiple who had already died. The owner drove away in the “same broken truck with the doors off, without properly security the animals,” which is required when transporting on the expressway, according to the municipal code, Webber stated.

Before leaving the scene, the dogs’ owner sold one of the animals to a bystander willing to help for $7,500, the executive director said.

“We have worked alongside Lake Station for many years and cannot explain why protocol was not followed,” Webber added. “Pursuant to our contract we are trying to seize possession of the remaining hospitalized pets so we can ensure an investigation is completed.”

In a Facebook post written in the hours following the incident, the Lake Station Police Department said it spoke with the person(s) involved and believed what occurred was not an act of animal cruelty or neglect, but a mechanical failure of the AC unit in the cargo area. Police didn’t specifically address the Humane Society’s involvement, but said, “The scene was chaotic and took an emotional toll on all that were involved in trying to save as many canines as possible.”

“Any loss of life is tragic and thoughts and prayers are with all those that were affect by this ‘freak event,'” the post continued, in part.

Carlee Russell charged in connection with Alabama kidnapping hoax

Authorities in Alabama said Friday they have filed criminal charges against a woman who confessed to fabricating a story that she was kidnapped after stopping to check on a toddler she saw walking on the side of the interstate. She has been charged with misdemeanor false reporting to law enforcement and falsely reporting an incident.

Hoover Police Chief Nick Derzis announced the charges against Carlee Russell at a news conference.

Russell, 25, disappeared after calling 911 on July 13 to report a toddler wandering beside a stretch of interstate. She returned home two days later and told police she had been abducted and forced into a vehicle.

Her disappearance became a national news story. Images of the missing 25-year-old were shared broadly on social media.

Her attorney, Emory Anthony, said she made the story up. In a statement read by police Monday, Anthony said Russell was not kidnapped, did not see a baby on the side of the road, did not leave the city and acted alone. He said Russell apologized and he asked for prayers and forgiveness as she “addresses her issues and attempts to move forward, understanding that she made a mistake in this matter.”

Russell told detectives she was taken by a man who came out of the trees when she stopped to check on the child, put her in a car and an 18-wheel truck, blindfolded her and held her at a home where a woman fed her cheese crackers, authorities said at a news conference last week. At some point, Carlee Russell said she was put in a vehicle again but managed to escape and run through the woods to her neighborhood.

Housing advocates push for City Council to enact a real estate transfer tax

Just over two months after taking office, Chicago Mayor Brandon Johnson is facing pressure to follow through on a major campaign promise.

Chanting “65K need a place to stay,” housing advocates gathered in the City Hall lobby Thursday afternoon, calling on Johnson to follow through on instituting a real estate transfer tax to improve city services by creating new streams of revenue.

The measure, called “Bring Chicago Home,” plans to pay for new, permanent housing for the the city’s homeless population by almost tripling the city’s real estate transfer tax on homes valued at $1 million or more.

The so-called “mansion tax” is expected to generate $163 million a year.

“We need a dedicated stream of revenue to address the need of those who, for whatever reason, are without shelter,” Bishop David Todd Whittley told members of the Council’s Housing and Real Estate Committee.

A similar measure stalled last year under then-Mayor Lori Lightfoot after more than two dozen City Council members failed to show up for a meeting about the ordinance. Bring Chicago Home was included in the new mayor’s transition report, and he has expressed support for the measure.

Commercial properties would be included in the plan, with some in Chicago’s multi-billion-dollar real estate industry saying that would be bad for business.  

According to a coalition that includes the Chicago Association of Realtors and the building owners and managers association, the proposal would almost triple the transfer tax on a $1 million home to nearly $30,000.

Amy Masters of BOMA Chicago told the committee that member buildings are still seeing soaring vacancy rates in the wake of the pandemic. “Market studies suggest that Chicago’s office buildings have lost 50% of their value, and we estimate that almost half of Chicago’s office buildings are in some state of financial distress,” she said.

Illinois Sec. of State to implement ‘Skip-the-Line' program at busiest DMVs

Changes could soon be in store for Illinois drivers facilities in the coming months as officials aim to shorten wait times across the state.

Illinois Secretary of State Alexi Giannoulias announced this week that a “Skip-the-Line” program will be implemented at the state’s busiest DMVs, allowing for extended hours and appointment scheduling.

In addition to extended hours and an appointment-only system for certain services at some locations, additional online services for renewal of driver’s licenses and license plate stickers are being introduced, with the program taking effect on Sept. 1.

Additionally, appointments will now be required for some services at 44 of the state’s busiest DMV locations, including all DMVs in Chicago and the surrounding suburbs.

Those seeking REAL ID, driver’s license and ID card services, and in-car driving tests will now be required to make an appointment for an in-person visit.

However, those seeking vehicle-related services, such as title, registration and license plate sticker renewal do not need to make an appointment.

Additionally, all DMVs in Illinois are extending their hours of operation, now open from 8 a.m. to 5:30 p.m. Monday through Friday.

More extended hours will be initiated at 16 DMVs throughout the state, which will be open from 8 a.m. to 12:30 p.m. on Saturdays as well.

Small plane crashes with 2 onboard in field near suburban airport: FAA

A plane with two people on board crashed near an airport in DeKalb Thursday afternoon, authorities said.

The single-engine Cessna 177 crashed at around 12:30 p.m. in a field near the DeKalb Taylor Municipal Airport, according to the Federal Aviation Administration.

The DeKalb County Sheriff’s office said at that time it received “several 911 calls” about a possible plane crash behind a business in Cortland.

Details on injuries weren’t immediately released, but authorities confirmed two males were onboard the aircraft at the time of the crash. The two people were taken to Northwest Kishwuakee Hospital in DeKalb for treatment.

The FAA and National Transportation Safety Board are investigating.
